Terms of Use
These Terms of Use (the “Terms”) constitute a binding legal agreement between you (“you,” “your,” or “User”) and One Fix Boston (“One Fix Boston,” “we,” “us,” or “our”), an independent residential and commercial appliance repair service operating in the City of Boston and the Greater Boston metropolitan area, Commonwealth of Massachusetts. These Terms govern your access to and use of onefix.boston (the “Site”) and any appliance-repair services, estimates, parts, warranties, or related services arranged through the Site or otherwise provided by One Fix Boston (collectively, the “Services”).
BY ACCESSING THE SITE, REQUESTING AN ESTIMATE, SCHEDULING A SERVICE APPOINTMENT, OR ACCEPTING WORK FROM ONE FIX BOSTON, YOU AGREE TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE, DO NOT USE THE SITE AND DO NOT ENGAGE OUR SERVICES.
1. Eligibility
The Site and Services are intended for individuals who are at least eighteen (18) years of age and who have the legal capacity to enter into binding contracts. By using the Site or engaging our Services, you represent and warrant that you meet these requirements and that, where you are scheduling service on behalf of a household, business, or other entity, you have authority to do so and to bind that entity to these Terms.
2. Scope of Services; Estimates
One Fix Boston provides diagnostic and repair services for residential and commercial household appliances. Any diagnostic findings, recommended repairs, or estimates communicated to you — whether orally, by SMS, by e-mail, or in writing — are based on the condition of the appliance and the information available at the time of inspection. Estimates are good-faith approximations and are subject to change if additional defects are discovered or if parts pricing changes. We will obtain your authorization before performing work that materially exceeds an approved estimate.
3. Appointments, Cancellations, and Access
You agree to provide accurate contact information, an accurate service address, and reasonable access to the appliance at the scheduled appointment time. If you must reschedule or cancel, you agree to provide notice as early as reasonably practicable. We reserve the right to assess a trip fee for missed appointments or for appointments at which our technician is denied reasonable access. You are responsible for ensuring that the work area is safe and accessible and that any animals are secured.
4. Diagnostic Fee, Charges, and Payment
Unless expressly waived in writing, a diagnostic fee applies to each service call. Labor, parts, and applicable taxes (including Massachusetts sales tax where required by law) will be itemized on your invoice. Payment is due upon completion of the work unless other arrangements are agreed in writing. Past-due balances accrue interest at the lesser of one and one-half percent (1.5%) per month or the maximum rate permitted under Massachusetts law, and you agree to pay reasonable costs of collection, including attorneys’ fees.
5. Parts; Title and Risk of Loss
Title to replacement parts passes to you upon installation and payment in full. Risk of loss passes upon installation. Original defective parts removed from your appliance become the property of One Fix Boston unless you request their return at the time of service. Special-order parts are non-returnable once ordered.
6. Limited Workmanship Warranty
One Fix Boston warrants the labor associated with a completed repair for a period of ninety (90) days from the date of completion, unless a different period is set forth on the invoice. Parts are covered by the manufacturer’s warranty, if any; One Fix Boston does not extend or replace any manufacturer warranty. This limited warranty does not cover:
- damage caused by misuse, abuse, accident, power surges, water intrusion, pests, or acts of God;
- cosmetic damage, normal wear and tear, or unrelated subsequent failures;
- repairs, modifications, or service performed by anyone other than One Fix Boston after the original repair;
- appliances that have been moved or reinstalled after service;
- appliances used outside their intended residential or commercial application; or
- any unit on which the original invoice has not been paid in full.
To make a warranty claim, contact One Fix Boston within the warranty period and present the original invoice. Our sole obligation, and your sole remedy, under this limited warranty is, at our option, to re-perform the original labor or to refund the labor charge for the original repair.
7. Disclaimer of Other Warranties
EXCEPT FOR THE EXPRESS LIMITED WARRANTY SET FORTH IN SECTION 6, AND TO THE FULLEST EXTENT PERMITTED BY MASSACHUSETTS LAW, THE SITE AND THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” AND ONE FIX BOSTON DISCLAIMS ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. Nothing in these Terms is intended to waive, restrict, or modify any non-waivable rights you may have under M.G.L. c. 93A (the Massachusetts Consumer Protection Act) or other applicable consumer-protection law.
8. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL ONE FIX BOSTON, ITS OWNERS, EMPLOYEES, OR CONTRACTORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, LOSS OF USE, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATING TO THE SITE, THE SERVICES, OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. EXCEPT WHERE PROHIBITED BY LAW, ONE FIX BOSTON’S AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO ANY GIVEN SERVICE APPOINTMENT SHALL NOT EXCEED THE AMOUNTS ACTUALLY PAID BY YOU TO ONE FIX BOSTON FOR THAT APPOINTMENT. Some jurisdictions do not allow the exclusion or limitation of certain damages; in such jurisdictions, our liability is limited to the maximum extent permitted by law.
9. Indemnification
You agree to defend, indemnify, and hold harmless One Fix Boston, its owners, employees, and contractors from and against any claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of (a) your breach of these Terms, (b) your misuse of the Site or the Services, (c) any condition of your premises that contributes to injury or damage during a service appointment, or (d) your violation of any law or the rights of any third party.
10. Use of the Site
You agree not to (i) use the Site for any unlawful purpose; (ii) attempt to gain unauthorized access to the Site, its servers, or related systems; (iii) interfere with the security, integrity, or operation of the Site; (iv) submit content that is false, defamatory, infringing, or unlawful; (v) use any automated means to access or scrape the Site without our prior written consent; or (vi) impersonate any person or entity.
11. User Submissions and Reviews
If you submit a review, photograph, comment, or other content (“User Content”) to the Site, you represent that the User Content is accurate and that you have the right to submit it. You grant One Fix Boston a non-exclusive, royalty-free, worldwide, perpetual, and sublicensable license to use, reproduce, display, and publish the User Content in connection with the Site and our marketing materials. You may request removal of your User Content by contacting Office@onefix.boston.
12. Intellectual Property
The Site, including its text, graphics, logos, images, and underlying code, is owned by One Fix Boston or its licensors and is protected by United States copyright, trademark, and other intellectual-property laws. Except for the limited right to access the Site for personal, non-commercial use, no rights are granted to you by these Terms. Manufacturer trademarks appearing on the Site are used for identification only and remain the property of their respective owners.
13. Third-Party Services and Links
The Site may contain links to or integrations with third-party websites or services, including scheduling and payment platforms. One Fix Boston is not responsible for the content, policies, or practices of any third party, and your use of such third-party services is governed by their own terms.
14. Electronic Communications and Consent
You consent to receive communications from us electronically — including by e-mail, SMS, and in-app notifications — and you agree that all agreements, notices, disclosures, and other communications we provide electronically satisfy any legal requirement that such communications be in writing. 15. Governing Law; Venue
These Terms are governed by, and construed in accordance with, the laws of the Commonwealth of Massachusetts, without regard to its conflict-of-laws principles. Any dispute, claim, or controversy arising out of or relating to these Terms or the Services that is not resolved informally shall be brought exclusively in the state courts located in Suffolk County, Massachusetts, or in the United States District Court for the District of Massachusetts, and you and One Fix Boston each consent to the personal jurisdiction of those courts.
16. Informal Dispute Resolution
Before initiating any formal proceeding, you agree to first contact One Fix Boston at Office@onefix.boston with a written description of the dispute, the relief sought, and your contact information, and to allow at least thirty (30) days for One Fix Boston to attempt to resolve the matter informally and in good faith.
17. Massachusetts Consumer Protection
Nothing in these Terms shall be construed to limit, waive, or modify any rights or remedies you may have under M.G.L. c. 93A or any other non-waivable consumer-protection statute, regulation, or rule of the Commonwealth of Massachusetts.
18. Force Majeure
One Fix Boston shall not be liable for any failure or delay in performance caused by circumstances beyond its reasonable control, including, without limitation, acts of God, severe weather, public-health emergencies, governmental orders, labor disputes, parts shortages, supply-chain disruptions, transportation delays, fire, flood, or utility failures.
19. Severability; Waiver; Assignment
If any provision of these Terms is held to be unenforceable, that provision shall be enforced to the maximum extent permissible, and the remaining provisions shall remain in full force and effect. Our failure to enforce any right is not a waiver of that right. You may not assign these Terms without our prior written consent; One Fix Boston may assign these Terms in connection with a sale, merger, or transfer of assets.
20. Entire Agreement; Changes
These Terms, together with our Privacy Policy and any invoice or written work authorization, constitute the entire agreement between you and One Fix Boston with respect to the Services and supersede any prior agreements. We may modify these Terms from time to time by posting the revised Terms on the Site; your continued use of the Site or our Services after the effective date constitutes acceptance.
